Parking Services: The Site may be used by potential customers to find the location and availability of certain parking spots (“Spots”) at the Garage, make a reservation for a Spot, and make payment for the parking privilege as well as make use of other service offerings available at the Garage, all subject to these Parking Terms (“Services”). We are not responsible for any consequences arising from utilizing the Services, including, without limitation, the unavailability of parking, issues with the Spot, delays associated with parking, road closures or changing traffic conditions, and failure to cancel a reservation within the cancellation window. Company does not guarantee that the Spot will be available, but if a booked Spot is unavailable at your time of reservation, we may reasonably address such unavailability by taking measures within our discretion such as attempting to locate an alternative Spot, providing you with a refund and/or otherwise resolving the issue in accordance with our standard customer service policies and procedures.
Reservations: We work with various partners to enable prospective customers to see available Spots at the Garage on our Site. Examples of our partners include Parking Panda®, SpotHero®, ParkWhiz®, Arrive®, and Way.com®. Users may select a Spot and make the reservation online. Reservations for parking may be made on a one-time or monthly basis (“Reservation“). Company has no liability or responsibility for Spot information contained on such partner sites. All Spot information is for informational purposes only and should not be relied upon to make parking decisions. While we strive to provide accurate information regarding the Spots listed on the Site, at times such information may become inaccurate and we are not be liable for any such inaccuracy. In all cases, your utilization of a Spot will be governed by applicable law, these Parking Terms, the Terms of Use, Privacy Policy and any policies in place from time to time and our standard operating procedures. By making a Reservation, you agree in all cases to abide by these Parking Terms.
User Account: In order to access certain areas of the Parking Site, you must create a user account and login (“User Account”) on the Site which will be used to provide Garage information to you and to allow you to make payment for the Services. User Accounts will require you to provide personal information such as your first name, last name, email address, employer (if on a company monthly plan), license plate number, car make and model, car color, and mailing address. Payments will be processed by a third party PCI complaint company. You must be over the age of 18 to create a User Account. All information which you provide through the Site in connection with creating your User Account or otherwise shall be current, accurate and complete. You are solely responsible for all activity that occurs with respect to your User Account. You are solely responsible for maintaining the confidentiality of your User Account and keeping the username and password to your User Account secure. You agree to notify us immediately of any security breach or unauthorized use of your User Account. We will not be liable for any costs, losses, claims or damages that you or any third party incur which are directly or indirectly caused by use or misuse of your User Account. Personal information supplied to us shall be collected, stored and processed in accordance with our Privacy Policy.
Monthly Parking: Monthly parking Services may be billed on a Subscription basis (“Subscriptions“). Customers will be billed in advance on a recurring billing cycle, with automatic renewal at the end of each billing cycle unless you cancel auto-renewal through your User Account management page, or by contacting our customer support team. Any change in fees for the Services becomes effective at the start of a new billing cycle. The Company will provide you with reasonable prior written notice of any change in fees to give you an opportunity to cancel your Subscription before the change becomes effective. General Fees: You are responsible for all charges, fees, duties, taxes, and assessments related to and arising out of any Reservation, the use of a Spot, the Services, Subscriptions, and your use of the Site, including everything arising out of your User Account. You agree to pay Company all fees for (including any overage fees) for the Services, in accordance with the pricing and payment terms presented to you for such Services. Payment may be made in any way specified on the Site or the partner companies including via credit card and ACH bank transfer. Monthly parkers may receive a monthly email with an invoice with an amount for payment and can make payment on the Site or by bringing their check to the Garage office. All amounts are due when invoiced, whether or not you used the Services. Except where required by law, all fees paid by you are non-refundable. The Parking Company may change the fees with notice to you.
Overage Fees: You are responsible for paying the entire fee assessed by Company for your use of the Services including all services fees and overage fees. Fees are inclusive of all anticipated applicable taxes. If you utilize the Garage and the Services for longer than your Reservation time, you are responsible for paying for the additional parking time. Overage fees shall be assessed by the Company within its sole discretion. Monthly parking overage fees which remain unpaid for 30 days after being billed are considered overdue. Failure to pay overage fees when due may result in a legal judgment against you. You shall be responsible for all legal and other fees associated with Company’s collection efforts to receive any unpaid fees.
No Refunds After Reservation Time: Reservations purchased through the Site are not refundable after the Reservation time, regardless of your use or non-use of the Spot irrespective of the reason for any non-use. You can cancel a Reservation before that time pursuant to the Company’s cancellation policy. Reservations made through a partner company are not refundable for any reason unless specifically set forth in that partner’s policies.
Coupons: Company may, on its own or through vendors or partner companies, issue promotional marketing incentives in the form of promotional codes, promotional discounts, coupon codes or other marketing incentives (“Coupons”). Coupons are personal to the recipient and have no value or other consideration and you, therefore, have no ownership interests or rights in the Coupons. Company reserves the right to deactivate or discontinue any Coupons at any time and for any reason, including, but not limited to, business necessity, mistake, failure to maintain an updated online account, unauthorized use or suspicion of fraud or abuse of any promotional program or Coupons. Further, the Company reserves the right to terminate or discontinue any promotional program or other program offering Coupons or other incentives at any time. It is within the sole discretion of the Company whether or not to accept Coupons. After a Reservation has been confirmed, no Coupon shall be accepted. Coupons cannot be combined with any additional coupons, special offers or other promotion at any time, including, but not limited to, when exiting the parking facility after using the Spot underlying a Reservation. Special discounts do not apply.
